Colombia's Constitutional Court unanimously struck down a tax on power generation companies and ordered the government to return the funds collected so far, El Pais reported on May 6.
In February, the court preemptively ruled that the government's declaration of an energy emergency was unconstitutional and confirmed the ruling in April. The decree aimed to raise funds to rescue energy utility Air-e, which is under federal intervention. Petro implemented the measure on Jan. 21 after declaring an economic emergency in December 2025, which included a 19% value-added tax on alcoholic beverages, an increase in income tax for financial institutions, and triple taxation for the mining and energy sector. The package aimed to raise the 16.3 trillion pesos ($4.3 billion) he had initially pursued via a tax reform that Congress twice rejected to fund the 2026 budget.
